We were instructed by a tenant who had, after some difficulties, recovered her full deposit from the landlord. The customer believed the deposit had not been correctly dealt with and when we had carried out our investigation we agreed with her.
A letter of claim was sent to the landlord on behalf of our customer and the landlord came back to us upon receipt of our letter to say that he had been unaware of what he needed to do to protect the deposit and confirmed that he had breached the regulations.
As the landlord accepted the legal position we were able to reach a quick settlement and thereby minimise the amount of money that the landlord had to pay. The customer received her statutory penalty within 14 days of instructing us.
